wabThe Peoples Democratic Party, PDP, Candidate for Aniocha North state constituency in the April 11, 2015 general elections, Engr. Emeka Emmanuel Nwaobi, has once again affirmed that he is the authentic candidate endorsed by the party for the elections, even as his Counsel, Barr. Ken Mozia, SAN, has hinted that the Aniocha North, PDP Candidate, has sufficient grounds to tackle any petition challenging his claim as the party candidate.
Engr. Nwaobi made this assertion while fielding questions with newsmen after the inaugural hearing of the matter brought before the court by another PDP member, Mr. Uzoma Idabor, who is claiming that he and not Engr Nwaobo is the authentic candidate of the PDP for the Aniocha North House of Assembly elections.
Nwaobi, who confirmed that he participated in the 2014 PDP Primary election to elect the Aniocha North House of Assembly candidate, however averred that he was surprised to hear allegations making the rounds that he had doctored the result which confirmed him as the endorsed candidate of the party, and eventually culminated in a litigation at an Abuja High Court challenging his candidature.
He was also quick to stress emphatically that contrary to unfounded speculations suggesting that he was arrested, he had only been invited by the police in Asaba, to shed more light on a petition of alleged forgery of election result and after satisfactorily addressing all the points raised in the said petition, had subsequently left the station and promptly returned to his political base in Issele Uku to allay fears of his purported arrest and re-assure his Aniocha North constituents that he was hale and hearty and still very much in the House of Assembly race as the PDP Candidate.
Engr. Nwaobi further affirmed his authenticity by insisting that the PDP had already issued him the certified true copies of all the relevant documents, duly signed by all the witnessing officers including party officials and candidates agents, endorsing him as the authentic candidate of the PDP for the Aniocha North House of Assembly elections.
“I have all the authentic and certified true copies of the relevant documents issued by the National Secretariat of the Peoples Democratic Party, PDP, and duly signed by all the relevant signatories, endorsing me as the authentic candidate of the party for the Aniocha North House of Assembly election”, he said.
Nwaobi then confirmed that he had already written a counter petition to Zone 5 Police Headquarters, Benin city, to the effect that the said Mr. Uzoma Idabor himself allegedly forged the documents with which he had gone to court to stake his claim and that Mr. Uzoma Idabor should stop parading himself as the authentic PDP candidate for the Aniocha North constituency, adding that, he has already briefed his counsel to explore ways of proceeding with the necessary legal processes to pursue the matter.
“I have also filed a counter petition against Mr. Uzoma Idabor, seeking that he should stop parading himself as the authentic Aniocha North PDP House of Assembly Candidate and that the result with which he has based his claims of the mandate is also forged and does not represent the true position of the party on the matter”, Nwaobi said.
The PDP Aniocha North House of Assembly candidate, pleaded with his constituents to remain resolute in their support for PDP and while he highlighted the financial burdens which the extension of the election dates by six weeks had imposed on politicians and equally hailed the impressive level of Personal Voter Cards, PVC’s collection in Aniocha North, assured that he would work assiduously to ensure victory for all the PDP Candidates in Aniocha North in the forthcoming general elections.
Nwaobi, who highlighted his track record in providing welfare and infrastructure development to the people of Aniocha North, even when he has not been elected into public office, pledged to run an open administration and make himself assessable to his people, even as he promised to provide more dividends of democracy to his constituents, if he gets the mandate as their legislator in 2015.
Meanwhile, very strong indications have emerged to suggest that Engr. Emeka Nwaobi has sufficient claims to prosecute his case successfully as the authentic PDP Aniocha North House of Assembly candidate for the April 11, 2015 elections.
This hint was expressed by Barr. Ken Mozia, SAN, counsel to Engr. Nwaobi, while fielding questions with newsmen after appearing in the first court session of the matter brought against his client by Mr. Uzoma Idabor, at the Asaba Federal High court.
Barr. Mozia, who confirmed that Mr. Uzoma Idabor, a PDP aspirant in the PDP Aniocha North primary for the Delta House of Assembly ticket, had filed an application with the Federal High court, Abuja, challenging the claims of Engr. Emeka Nwaobi as the authentic candidate of the Aniocha North PDP House of Assembly election, however noted that they had successfully challenged the matter of jurisdiction, which led to the case been subsequently transferred to the Asaba High Court.
The counsel further affirmed that, while some old applications had now been overtaken by events, the court had also granted all parties to the matter the leave to finalise the process of preparing and submitting all relevant applications on the matter before the court, even as he added that his client, Engr. Emeka Nwaobi has provided all the necessary and relevant briefs, including documentary evidence to show that he was indeed the authentic PDP Aniocha North House of Assembly candidate.
Mozia, who equally asserted that the case before the Asaba High Court was a pre-election matter and the adjudication of pre-election matters were not bound by the date the elections, also noted that the matter was an intra-party matter involving two Delta PDP politicians, who are free to approach the court to seek redress in the event of a perceived injustice.
While hinting that his client has fully consider the option of exploring the possibility of an amicable settlement out of court, Barr. Mozia however stated emphatically that he would have been the first to advise his client to withdraw if there was the slightest indication that he did not have a good case, but having been availed of the supporting documents for the case, he has no doubts that Engr. Emeka Nwaobi has a good case which will be argued vigourously before the courts on the next date of hearing.
“It is the duty of every responsible counsel to advise parties to a matter to first explore possibilities of an alternative dispute resolution before going to court and I have so advised my client. But if I had any doubts that he did not have a good case I would have also impressed same on him. We have a good case and since the matter is already before the courts we will argue our case before the judge once the substantive hearing begins”, Mozia said.
“Pre election matters are not bound by the dates of an election as the matter can go on and ruling given even after elections have been conducted so we are not compelled by law to finish the matter before the elections commence. This is an intra party matter between two PDP politicians and not between PDP and another political party, and as such, no one is contravening the laid down rules of the political party”, the learned SAN said.
The matter was then adjourned to March 24, by the presiding Judge as the date for next hearing.
